Competition rules and regulations for online questionnaires organised by Profacts
Article 1 Organisation
The competition is organised by Profacts B.V.B.A., which has its registered office in Eedstraat 31A, 9810 Eke. There shall be no correspondence or telephone conversations on the progress of the competition or the application of the rules and regulations.
Article 2 Competition Conditions
Entry conditions and prizes are explained in the competition and/or are determined by the selection criteria applied to the questionnaire.
Prizes cannot be exchanged for cash.
Entrants answer the simple competition question to stand a chance of winning a prize.
Entrants also have to answer the tiebreaker question.
All persons older than 18 years and resident on Belgian territory may enter, with the exception of personnel members of the organisers, the companies (including personnel members and employees) involved in organising the competition.
There can only be 1 entrant per email address. Not more than one prize will be allocated per address / residence where several persons live together as a family. In the case of several answers, participation or entries, Profacts will only take the entry received first into account.
Entrants who answer the competition question correctly will qualify for the prize. The person whose answer is closest to the [correct answer to the] tiebreaker question wins the competition. If there is a tiebreak, the person who sent in his/her entry first will win.
The winners will be personally notified by email.
Article 3 General
The winner declares that he/she automatically agrees that his/her initials, surname, address and prize won are published. Just by entering, all entrants automatically and unconditionally consent to the publication of these particulars.
All correspondence on this competition is exclusively by email. The contact address is Profactsteam@profacts.be. In addition, there shall be no communication on either the result or the competition.
The personal data that the organisers gather on the entrants fall under the application of Article 4 § 1 of the law of 8 December 1992 on the protection of privacy in relation to the processing of personal data. Entrants have free access to these data at Profacts so that, if necessary, they can request that the data be corrected and/or deleted. If the nature of the competition requires that email messages be sent repeatedly, the entrant accepts that he/she receives those messages for the entire course of the competition.
Article 4 Force Majeure / Reservation
Participating in the competition implies that one knows and accepts the properties and limitations of the Internet, particularly regarding technical performance, risk of disruptions and, more generally, the risks inherent to all connections and transmissions via the Internet, the absence of security of certain data regarding possible detours and risks of contamination by possible viruses on the network.
Consequently, Profacts B.V.B.A. can under no circumstances be held liable for, among others, the following:
- transmissions via the Internet,
- bad functioning of the Internet and/or software used;
- the consequences of viruses, bugs, anomalies and technical defects;
- technical, hardware and software defects of whatever nature.
Profacts B.V.B.A. cannot be held liable for direct or indirect damage pursuant to disruptions, any form of malfunction and exclusion of entrants or termination of the competition, for whatever reason. This shall apply to any direct or indirect damage that might emanate from a connection with its web site. All entrants must take all the necessary measures to secure their own data and/or the software programs on their informatics equipment and/or their web sites against all damage of whatever nature.
Profacts B.V.B.A. can also not be held liable if the present competition has to be changed, shortened or cancelled due to force majeure or for reasons beyond its control. The organisers reserve the right to change, postpone, shorten or withdraw the competition or a part of it, if circumstances require such action. The organisers cannot be held liable for this. Printing, spelling, typesetting or other errors cannot be invoked as grounds for any obligation whatsoever.
Profacts B.V.B.A. reserves the right to check that the rules are respected, in particular, to exclude any entrant who has abused them. However, Profacts B.V.B.A. is not obliged to systematically check all entry forms sent in and may confine itself to checking only the winners. During the competition and after Profacts B.V.B.A. has made such an announcement, any possible additions or, in the case of force majeure, amendments, may be published. They will be regarded as annexes to the present rules and regulations.
If it is reported that there may be fraud or clear unlawful influencing of the competition, Profacts B.V.B.A. reserves the right to exclude entrants from the competition without any prior notification.
Article 5 Disputes
By entering in this competition, the entrant automatically agrees with all the points of the competition rules and regulations, with the result and with the decisions that the organisation took or is to take within the context of the competition. The organisation shall take ad hoc decisions on any possible points not stated in the rules and regulations, without any recourse by or notification to the entrants. Participation in this competition signifies that one accepts all the stipulations of these rules and regulations, and the organisers’ decisions.
All persons over the age of 18 years and established on Belgian territory may, at the most, validly participate only once per competition and per email address. Any attempt at fraud shall be punished by the entrant’s immediate exclusion. Printing, spelling and typesetting or other similar errors can in no way whatsoever compromise the liability of Profacts B.V.B.A. In general, Profacts B.V.B.A. formally disclaims any possible liability regarding this free competition. The organisation can also not be held liable for any possible technical problems or defects.
It is forbidden to approach Profacts or its personnel members for assistance in solving the competition questions, either directly or indirectly, via helpdesk, by email, telephone, fax, letter, or any other means and this may lead to being excluded from the competition. All additional statements and/or publications regarding the competition shall apply as points of the rules and regulations. All decisions on the part of the organisers shall be without recourse.
If there are any abuses, cases of deception or fraud, the organisers explicitly reserve the right to exclude the entrant(s) concerned without delay from entering this and/or other competitions.
